Paddle In The Park Contest #PathOfThePortageur and  #PaddlePoints Events – Official Rules

The Paddle In The Park Contest Paddling Seeking Event “#PathOfThePortageur” and the Paddle In The Park Contest Paddle Points Event “#PaddlePoints Challenge”, is hosted by Badger Paddles and Portageur.ca, herein after referred to as the “Organizers” or “Contest Organizers”.

Open to Canadian residents (excluding Quebec) and most of the U.S.A. Read below for full eligibility requirements.

The following rules and regulations refer to both the #PathOfThePortageur and the #PaddlePoints Challenge portions of the Paddle In The Park Contest unless stated otherwise.

 

General Contest Rules & Information:

General Information: The Paddle In The Park Contest prizes will be administered by way of two methods. The first method will be by way of contestants finding a hidden paddle(s) (subsequently referred to as “#PathOfThePortageur”) with a chance to receive a associated prize pack for the paddle once the contestant’s claim has been officially verified by Paddle In The Park Contest Organizers, as well as a chance to win the #PathOfThePortageur Grand Paddle Finder Prize Pack. The second method is by way of contestants uploading canoeing/camping photos depicting the completion of various outdoor related tasks (subsequently referred to as “#PaddlePoints Challenge”) for a chance to win various prizes. No purchase is necessary to participate in any portion of this contest. All entrants are responsible for reading the Paddle In The Park Contest Rules & Regulations upon entry to any portion of this contest, and failure to do so could result in immediate disqualification from any or all portions the Paddle In The Park Contest and the entrant will be deemed ineligible.

 

Decisions as to the validity of entries or to whom is eligible for prizes and prize packages will be made by the Contest Organizers, arbitrarily and at their discretion, though may be influenced by the “spirit of the contest” (as defined by the Contest Organizers), and the apparent fairness of each individual circumstance.

 

Participation: Contestants are able to participate in both The Paddle In The Park Contest Paddle Seeking Event #PathOfThePortageur and the Paddle In The Park Contest #PaddlePoints Challenge simultaneously. The #PathOfThePortageur Winners are still eligible for all the #PaddlePoints Challenge prizes – unless they have also won the #PathOfThePortageur Grand (Paddle Finder) Prize Package.

Previous winners: In order to maintain the integrity and spirit of the Paddle In The Park Contest and the Paddling Seeking Event “#PathOfThePortageur, that is to say getting more people to spend time in our parks and other natural wilderness settings, only one (1) hidden PITPC paddle per contestant may be found and claimed per lifetime of the contest. In the event that a Contestant attempts to claim prizes by finding a paddle, they will be asked to return the paddle and any further prizes associated with finding a paddle will instead be redistributed as prizes as the Contest Organizers see fit.

While Paddle-finders (winners) from previous years (Paddle in the Park Contest 2013, 2014, 2015, 2016, and 2017) will not be eligible to officially claim a paddle or prizes in 2019, previous Paddle-finders (winners) are still welcome to find any 2019 hidden paddles if they agree to leave the paddle, where is and as is, for another to claim and only take a photo of their paddle find, for official record keeping, and that photo be submitted to the Organizers for official recognition as part of the Paddle in the Park Contest Hall of Fame. No prizes will be awarded for such finds.

All previous #PaddlePoints Challenge winners are edible to participate and win prizes as part of the 2019 #PaddlePoints Challenge, with the exception of their previous won class or sub-class. For example, a 2017 Explorer Prize Package winner will not be eligible to win the 2019 Explorer Prize Package, but is still eligible to win the Pathfinder or Wilderness Guide Prize Packages. This same rule also applies to all sub classes. For example, a 2017 Wilderness Guide – Trip Leader Prize Package winner will not be eligible to win the 2019 Wilderness Guide Prize Package, but is still eligible to win the Explorer or Pathfinder Prize Packages. Also, any past Grand Prize winners of any previous #PaddlePoints Challenge who received a canoe as part of their prize package, will no be eligible to win any 2019 Paddle in the Park Contest prize package that includes a canoe, such as the #PathOfThePortageur Grand (Paddle Finder) Prize Package or the 2019 Wilderness Guide Grand Prize Package.  If a particular #PaddlePoints class from 2015, 2016, 0r 2017 does not exist for the 2019 #PaddlePoints Challenge, then the contestant is still eligible to participate and claim prizes for the existing 2019 #PaddlePoints classes. For example, the Tenderfoot class no longer exists as part of the 2019 #PaddlePoints campaign, thus a 2016 Tenderfoot Prize Package winner is still eligible to participate and claim prizes for the 2019 #PaddlePoints Challenge including the Explorer, Pathfinder, or Wilderness Guide Prize Packages.

Rules specific to the “#PathOfThePortageur portion of the Paddle In The Park Contest:

Contest Period: The #PathOfThePortageur portion of the contest officially begins at 12:01 a.m. EST on July 1, 2019, and ends at 11:59 p.m. EST on October 28th, 2019 or when all the paddles have been found and claimed – which ever comes first.

 

Entry: There is no official entry form for #PathOfThePortageur portion of the contest. The winners of the #PathOfThePortageur portion of this contest are those who first take possession of the hidden paddle. There can only be one winner per hidden paddle. #PathOfThePortageur Contestants may find and claim only 1 (one) paddle in the #PathOfThePortageur portion of the Paddle In The Park Contest.

Note: To ensure the Paddle in the Park Contest mandate, to get more people “Out There”, as of 2017, previous paddle finders will no longer be eligible to claim paddles or prizes in the “#PathOfThePortageur portion of the Paddle in the Park Contest. Please see this post for further details.

Claiming A Paddle: There will be 10 (ten) paddles hidden in total and are identified by an official Paddle In The Park Contest wooden information tag and other individual identifying marks on the paddle.

Paddle-finder winners must contact Paddle In The Park Contest Organizers to officially claim the found paddle as a prize in order to be eligible to receive the associated prize pack for the claimed paddle. If Contest Organizers deem a contestant or person’s paddle find or claim to be in violation of these Contest Rules or deemed ineligible for any reason, that person will forfeit their right to any and all prizes, and may be asked to return the found paddle to the Paddle In The Park Contest Organizers.

If a Contest Organizer is not present when a paddle is found, any and all disputes on who was first to take possession of a hidden paddle will have to be decided on satisfactorily by those present and is in no way the decision of the contest Organizers or Sponsors.

If a Contest Organizer is present when a paddle is found, it will be at the discretion of that Contest Organizer to decide to whom the paddle will be awarded, as they see fit. Further, it will be completely up to the Contest Organizer’s discretion to determine when a paddle is available to be found, for example, when the Organizer has stored the paddle for the night or is transporting the paddle between hiding locations. (In practice, paddles available to claim will be visible, with the PITPC wooden tag also visible and tied to the paddle, or a prominent Paddle In The Park Contest Banner displayed in close proximity to the paddle’s location.) In some cases, the Contest Organizer may require a skill testing question or some kind of task to be performed in order to either claim your paddle or to settle disputes, such as who was the first to claim the paddle.

All paddle claims are final once approved by Paddle In The Park Contest Organizers.

In the event, a paddle has not been claimed by the end of the contest period, the location of the paddle will be publicly disclosed. If a paddle remains unfound and unclaimed past the end of the contest period and after a time deemed fit by the Organizers, the paddle itself will be deemed as “lost” and will not be awarded.

All potential contest participants must respect and obey all conservation area and/or park policies, rules and regulations while within the park, including possessing the required park permit(s) as well as adhere to all other interior/backcountry/campground/park stipulations.

All contest paddles and prizes are to be taken as is. The contest Organizers and/or contest contributors are not responsible for any items that have damage including that from the elements, weather, vandalism, theft, animals, or as a result from any other unforeseen circumstances be it purposely inflicted or accidental.

 

Awarding the #PathOfThePortageur Grand (Paddle Finder) Prize Package: The winner of the #PathOfThePortageur Grand (Paddle Finder) Prize Pack will be chosen by way of random selection from all eligible contestants who have officially found and claimed a hidden 2019 Paddle in the Park Contest paddle by the end of the contest period. Liability Limitation: Enter at your own risk. Entrants agree to release and hold harmless all Organizers, Contest Hosts, Promoters and Sponsors, the Parks, their affiliates and subsidiaries, and each of their respective directors, officers, employees, agents, successors, and assigns, from any damage, injury, death, loss, or other liability that may arise from entrant’s participation in the Contest, including while locating the hidden paddle, or the awarding, acceptance, use, or misuse of any prize.

 

Eligibility: Contest is open to any individual over the age of majority and a legal resident of Canada (excluding Quebec), or age 21 or older and who is a legal resident of the continental United States (excluding residents of Rhode Island, Arizona, Hawaii, Florida, Alaska), and who has visited Ontario, Canada during the #PathOfThePortageur contest period. Entrants must be present in Ontario, Canada at the time they participate and/or win the #PathOfThePortageur portion of the contest.

This Contest is void where prohibited. Volunteers and employees of the Organizers, its affiliates and subsidiary companies, its agents and advertising agencies are not eligible for any prizes. As well, immediate family members (parent, child, sibling and spouse) of such an employee or volunteer and any person domiciled with such an employee or volunteer are not eligible.

Employees of the prize sponsor(s) as those listed in the sponsor section of the website paddleintheparkcontest.ca, its affiliates and subsidiary companies, its agents and advertising agencies are not eligible for any prizes. As well, immediate family members (parent, child, sibling and spouse) of such an employee and any person domiciled with such an employee are not eligible.

Contest Organizers and their appointed associates, sponsors, supporters, and the “paddle hiders” reserve the right to relocate the hidden paddles as the contest progresses, for any reason, including in order to comply with provincial park rules and restrictions.

Paddles found before or after the date of the contest official start and end times will still be honoured.

Prize packages not claimed by paddle-finders by November 30th, 2019 will be forfeited. The Paddle In The Park Contest will award any unclaimed prizes by way of random selection, or as seen fit at the time, and is at the sole discretion of Paddle In The Park Contest Organizers.

 

Odds: As set out above, there are ten (10) hidden #PathOfThePortageur canoe paddles with ten (10) associated #PathOfThePortageur Prize Packs available to be won: and only one (1) #PathOfThePortageur Grand Paddle Finder Prize Pack available to win for the 2019 Paddle In The Park Contest’s #PaddlePoints Contest event.

The odds of winning any #PathOfThePortageur paddle and associated prize pack will depend on the number of qualified contestants seek to find a claim a paddle over the Contest Period.

The odds of winning the #PathOfThePortageur Grand Paddle Finder Prize Pack are approximately 1 in 10 (or better) depending on the final results and success of the 2019 paddle hiding and finding campaign.

 

Multiple Winners: In order to maintain the integrity and spirit of the Paddle In The Park Contest and the Paddling Seeking Event “#PathOfThePortageur, that is to say getting more people to spend time in our parks and other natural wilderness settings, only one (1) hidden PITPC paddle per contestant may be found and claimed per lifetime of the contest. In the event that a Contestant attempts to claim prizes by finding a paddle, they will be asked to return the paddle and any further prizes associated with finding a paddle will instead be redistributed as prizes as the Contest Organizers see fit.

Prizes: Each prize must be accepted as awarded. A prize is not convertible to cash and has no cash value. No transfer or substitution by the winner of any part of a prize is permitted.

The Organizers reserve the right to substitute any part of a prize with a prize or prizes of equal or greater value for any reason. All remaining associated paddle prizes for the #PathOfThePortageur prizes/prize packs, with the exception of the #PathOfThePortageur Grand Paddle Finder Prize Pack, will be sent to the winners via mail or by way of some other mutually agreed upon method or arrangement.

Winners are responsible for any or all extra duties, taxes, and/or any other fees that have not been declared by Organizer’s or Sponsor’s shipper at the point of service purchase or as written and declared on the Organizer’s or Sponsor’s original shipping/mailing receipt. Winners are also required to be knowledgeable of their provincial or state requirements, laws and practices as it pertains to this contest, and the prizes won or accepted by said winner; and as such, the winner will bear the sole responsibility of any and all duties, taxes, or any fee, be it state, provincial, federal or otherwise and does not hold the Sponsor liable for any financial compensation.

Rules specific to the #PaddlePoints Challenge portion of the Paddle In The Park Contest:

By participating in this promotional contest (the #PaddlePoints Challenge), each participant unconditionally accepts and agrees to: a) the terms and conditions set out in these Official Rules, and b) the decisions of the Organizers with respect to all aspects of the Contest, which decisions will be final and binding.

 

No Purchase Necessary: No purchase is necessary to enter the Paddle Points contest.

Paddle In The Park Contest Organizers reserve the right to void or reject any entry, without notice or explanation.

The “#PathOfThePortageur Paddle-finder Winners are still eligible for all the #PaddlePoints Challenge prizes. However, #PaddlePoints Challenge Prize Pack winners may only win one (1) #PaddlePoints Challenge Prize Pack. #PaddlePoints Contest contestants who are successfully selected to receive any #PaddlePoints Contest Prize Pack will not be re-entered to receive any subsequent #PaddlePoints Contest Prizes/Prize Package(s). For example, the winner of the “Wilderness Guide” Grand Prize Package will no longer be eligible to receive any of the remaining #PaddlePoints Class Prize Packs available to be won, and will not be re-entered or re-selected for any further prize packs or prizes for the lifetime of the #PaddlePoints Contest.

 

#PaddlePoints Challenge Contest Period: The #PaddlePoints Challenge opens at 12:01 a.m. Eastern Standard Time (EST) July 7, 2019 (the “Contest Start Date) and closes at 11:59:59 p.m. EST November 5, 2019 (the “Contest End Date”). The period between the Contest Start Date and the Contest End Date is known as the “Contest Period”.

 

Entry: You may enter online via the paddleintheparkcontest.ca website where you will be prompted to create a “Paddle Points” account and upload images and photos to verify the completion of the official list of #PaddlePoints “Tasks” in order to earn points towards the chance to win prizes. 2019 or newly submitted photos only please – duplicated photos from past “Contest” seasons, or any photos already submitted during the previous 2015, 2016 or 2017 #PaddlePoints Contest seasons, will not be verified or deemed eligible for any #PaddlePoints.

Alternatively, you may enter the Contest via mail by sending your photos and images, along with your complete name, mailing address, phone number, age, and all other necessary details to the Paddle In The Park Contest organizer. All images entered must be marked on the back of each image or photo, with a description of the related Paddle Points task as found on the official Paddle In The Park website. You must include your photo package along with all required information and send it to Paddle In The Park Contest, c/o Badger Paddles, 4296 Ravenscliffe Rd., Huntsville ON, P1H 2J2, Canada. Contest entries must be received by the close of the Contest Period in order to be eligible for any prize. Failure to follow these instructions will result in photo or entrant disqualification, without notice or explanation.

Note: If you do not have access to a computer or the internet, you may write to us for a complete Paddle Points Task List by sending a self addressed stamped envelope to Paddle In The Park Contest, c/o Badger Paddles, 4296 Ravenscliffe Rd., Huntsville ON, P1H 2J2, Canada and we will send you a copy of the official Paddle Points Task List for your reference.

A participant’s entry will be disqualified if he/she: (i) provides information that is incomplete or inaccurate, (ii) fails to comply with or attempts to circumvent any of the terms and conditions of these Official Rules, or (iii) does not meet the eligibility requirements set out in these Official Rules.

During the Contest Period, each valid image/photo entry will be eligible for “#PaddlePoints”. #PaddlePoints will accumulate as the contest period progresses where the number of points earned by contestants, depend on the number of #PaddlePoints Tasks completed. Each #PaddlePoints Task is to be completed by uploading a photo or image depicting the assigned outdoor related activity. Photos may be entered only once. No duplicate photos allowed.

 

Task And #PaddlePoint Values: Utilize the official #PaddlePoints Flags/Paperwork to maximize the Paddle Points value for each task. The #PaddlePoints Flag/Paperwork is defined as any one of the official Paddle In The Park Contest images made available via the Paddle In the Park Contest website, which are free to download, copy, and print for personal contestant (noncommercial) use. The official hashtag #RewardsAreOutThere, in substitution of past Flags/Paperwork, can also be incorporated for more points. Number of #PaddlePoints will be applied in accordance to the Paperwork used. If two Flags or pieces of Paperwork or the official hashtag are all incorporated into the photo, only the most current and highest valued piece of Paperwork value will be applied to said photo. (Example: If the Task photo shows the assigned task with a 2019 Flag/Paperwork image and the official hashtag, only the extra points for the 2019 Flag/Paperwork will be allotted to said task photo; the extra hashtag will add no extra value for said Task photo.).

Important to note: All #PaddlePoints Flags and/or the official hashtag #RewardsAreOutThere must be incorporated in the photo in a natural (in the moment) or organic manner and not by means of digital manipulation nor computer/app photo or other editing programs. Photos digitally altered to add a #PaddlePoints Flag or the official hashtag “#RewardsAreOutThere will be deemed as disqualified and we not receive any #PaddlePoints or 0 (zero) #PaddlePoints.

New 2019 Anniversary #PaddlePoints Flags and Paperwork: All images and photos that include or depict a legible copy of any of the official 2019 #PaddlePoints Flags/Paperwork (free to download, copy and print for personal contestant use) will receive full value for the number of points for that related #PaddlePoints Task. Note: Each 2019 task photo has a total possible value of 10 (ten) #PaddlePoints. For example, a #PaddlePoint task with a total possible value of 10 (ten) points where the photo also depicts the 2019 #PaddlePoints Flag/Paperwork or “#RewardsAreOutThere” will be valued at a total of 10 (ten) points.

Past #PaddlePoints Flags and Paperwork: All images and photos that include or depict a legible copy of any past official 2015/2016/2017 #PaddlePoints Flag/Paperwork or the official “Contest” promotional hashtag “#RewardsAreOutThere, will receive only 5 (five) points for the related #PaddlePoints Task. For example, a Paddle Point task with a total possible value of 10 (ten) points where the photo also depicts the 2015, 2016, 0r 2017 #PaddlePoints Flag/Paperwork or “#RewardsAreOutThere” will be valued at a total of only 5 (five) points.

No #PaddlePoints Flag/No Official Hashtag: All images and photos that do NOT include or depict a legible copy of any official #PaddlePoints Flag/Paperwork or the official “Contest” promotional hashtag “#RewardsAreOutThere will receive only 1 (one) point for the related #PaddlePoints Task. For example, a Paddle Point task with a total possible value of 10 (ten) points where the photo does NOT depict any #PaddlePoints Flag/Paperwork or “#RewardsAreOutThere” will be valued at total of only 1 (one) point.

Note: You cannot combine Flags or the hashtag option for extra points. Only the option with the highest #PADDLEPOINTS value will be counted for each photo. For example: A contestant who submits a photo that displays the 2019 Flag (value 10 points) and a 2015 Flag (value 5 points) in the same photo, will only be allotted 10 points for said photo submission.

Note: Former official Paddle in the Park Paddle Finders who use their officially found paddle in their submitted photos will receive maximum points  as long as (a) the paddle is clearly recognizable as a paddle found in the Contest, and (b) the photo used has not been submitted in previous years.

 

Official Flags/Paperwork: There are 6 (six) different styles of #PaddlePoints Flags in total that can be downloaded by contestants and contest participants for free, as found on the website. www.paddleintheparkcontest.ca Stickers of the #PaddlePoints Flags/Paperwork are also available for purchase and are given the same #PaddlePoints value(s) as described above, for the purposes of this contest.

 

Photo Verification: All photos are subject to verification. Any photo entry that Organizers judge as inappropriate, or depicts the harassment of wildlife (eg. getting too close to a moose) or pictures showing damaging camping practices or techniques (eg. the cutting of live trees or branches), or has a negative message that conflicts with the Paddle In The Park Contest principles, will be deemed ineligible. Further the Contestant may also be subject to a deduction in their total #PaddlePoints, or as the Sponsors see fit, including complete disqualification from the Contest.

 

Paddle Point Titles/Class System: Contestants will be ranked by “#PaddlePoints” classification title categories according to the number of points they accumulate as the contest progresses, where the Wilderness Guide title is the top or first class, the Pathfinder title is the second class category, and the Explore title as the third place category. As the Contestant completes the #PaddlePoints tasks, they will earn a number of “#PaddlePoints”.

Receiving Prizes: There is one (1) first place “Wilderness Guide – Grand Prize” available to be won; and two (2) #PaddlePoints Class Prize Packs to be won: one (1) individual random prize pack for each of the three (2) remaining #PaddlePoints Classes (“Pathfinder”, and “Explorer”).

Each prize must be accepted as awarded. A prize is not convertible to cash and has no cash value. No transfer or substitution by the winner of any part of a prize is permitted. The organizer reserves the right to substitute any part of a prize with a prize or prizes of equal or greater value for any reason. All prize packs – with the exception of the Wilderness Guide Prize Pack (which includes the Grand Prize of a Swift Prospector Canoe) and the #PathOfThePortageur Grand Paddle Finder Prize Pack (which includes the Grand Prize of a Nova Craft Prospector Canoe) – will be sent to the winners via mail or by way of some other mutually agreed upon method or arrangements. All Grand Prize canoe winners will be responsible for the pick up of their canoe prize pack. Cost of canoe delivery, and any extra duties, fees, or taxes, is the sole responsibility of the both the #PathOfThePortageur Grand (Paddle Finder) Prize Winner and the #PaddlePoints Wilderness Guide Grand Prize Pack Winner accordingly .

Note: All winners who have their items shipped or mailed by the Sponsor are responsible for any or all extra duties, taxes, and/or any other fees that have not been declared by Sponsor’s shipper at the point of service purchase or as written and declared on the Sponsor’s original shipping/mailing receipt. Winners are also required to be knowledgeable of their provincial or state requirements, laws and practices as it pertains to this contest, and the prizes won or accepted by said winner; and as such, the winner will bear the sole responsibility of any and all duties, taxes, or any fee, be it state, provincial, federal or otherwise and does not hold the Sponsor liable for any financial compensation.

Winner of the “The Pathfinder Prize Pack”: On or before November 15, 2019, the Sponsor will RANDOMLY select the winner of The Pathfinder Prize Pack from the list of all eligible contestants who have placed in the “Pathfinder” title class. In the event that there are no contestants placed in the Pathfinder Class, the Sponsor will RANDOMLY select a winner from all eligible contestants across all title classes.

Winner of the “The Explorer Prize Pack”: On or before November 15, 2019, the Sponsor will RANDOMLY select the winner of The Explorer Prize Pack from the list of all eligible contestants who have placed in the “Explorer” title class. Cost of canoe and prize delivery, and any extra duties, fees, or taxes, is the sole responsibility of the Wilderness Guide Grand Prize Winner. The winning contestant is also responsible for all arrangements regarding their canoe and prizes by making direct contact with Mike Ramsay at Swift Canoe.

Contacting the Winners: The winners of the #PaddlePoints Prize Packs “The Wilderness Guide Grand Prize Pack”, “The Pathfinder Prize Pack”, and “The Explorer Prize Pack”) will be contacted by email by contest Organizers at the email address provided by the Contestant when they create their Paddle In The Park Contest #PaddlePoints Account, or as received by mail, as applicable. Only three attempts will be made, to contact the winner(s) each on a different day. For the second and third attempt, the winner will be contacted by phone at the phone number provided by the contestant, if a contact phone number has indeed been provided by the contestant. A voice message will be left if possible. If direct contact is not made with the selected participant for any reason within forty-eight (48) hours of the last attempt, or the selected participant is unwilling or unable to comply with these rules, they will thereby forfeit the Prize and another eligble contest participant’s entry will be randomly selected.

All #PaddlePoints Challenge prize winners may need to correctly answer, unaided, a skill-testing question asked over the telephone at a time mutually convenient to the selected participant and the Organizers. The winners of the #PaddlePoints Prize Packs may also have to correctly answer, unaided, a skill-testing question asked over the telephone at a time mutually convenient to the selected participant and the Organizers.

All prize winners may be required to complete, sign and return a ‘Declaration of Eligibility’ form, seven (7) days from date of official notification if requested, in which he/she confirms their eligibility and a ‘Waiver and Assumption of Risks’ form in which the winner agrees, to assume all risks associated with acceptance and use of the Prize.

The #PathOfThePortageur Paddle-finder Winners are still eligible for all the #PaddlePoints Challenge prizes, unless they have also won the #PathOfThePortageur Grand (Paddle Finder) Prize Package. However, #PaddlePoints Challenge Prize Pack winners may only win one (1) #PaddlePoints Challenge Prize Pack. #PaddlePoints Contest contestants who are successfully selected to receive any #PaddlePoints Contest Prize Pack will not be re-entered to receive any subsequent #PaddlePoints Contest Prizes/Prize Package(s). For example, the winner of the “Wilderness Guide” Grand Prize Package will no longer be eligible to receive any of the remaining #PaddlePoints Class Prize Packs available to be won, and will not be re-entered or re-selected for any further prize packs or prizes for the duration of the #PaddlePoints Contest.

 

Odds: As set out above, there is (1) first place “Wilderness Guide” Grand Prize Package available to be won; and two (2) #PaddlePoints Class Prize Packs to be won: one (1) prize pack for each of the remaining two (2) #PaddlePoints Classes (“Pathfinder”, and “Explorer”) for the 2019 Paddle In The Park Contest’s #PaddlePoints Contest event.

The odds of winning any prize will depend on the number of qualified entries received over the Contest Period.

Only one (1) #PaddlePoints Challenge Prize (Prize Pack) will be awarded per winning contestant for the #PaddlePoints Challenge.

 

Selection of Winners:

The Organizers will select the #PaddlePoints Class Prize Pack Winners in the following order:

2) Pathfinder Prize Pack

3) Explorer Prize Pack

General Contest Rules & Information Continued: 

Assumption of Risk: Each winner understands that the receipt and use of any Contest Prize may present inherent risks of personal injury and death, which may arise as a result of accident, negligence, deliberate acts or otherwise, and which may or may not be known and which may or may not be foreseeable and which may arise before, during and following use of the prize. The winner agrees to assume all such risks of personal injury and death. If the winner does not agree to assume all such risks of personal injury and death, then the winner cannot accept the Prize.

Liability Limitation: Each winner agrees that the Organizers, and each of the organizer’s agents and representatives, and each of their directors, officers and employees (collectively, all of the foregoing are the “Released Parties”) shall not be liable to him or her or any of their heirs for property damage, injury or death, or any other loss or damage that may arise: (i) as a result, whether wholly or partially, of any act or omission of any of the Released Parties, or (ii) by reason of any event over which any of the Released Parties has no control.

Indemnity: Each winner hereby agrees to indemnify and hold harmless each of the Released Parties from any and all claims, demands and liability for any injury, loss or damage of any kind to any person or persons, including death and property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a Prize or any part of a Prize or participation in the Contest or participation in any Prize related Activity.

Disclaimer of Warranty: The Organizers make no warranty, guaranty or representation of any kind concerning the Prizes and disclaims any implied warranty.

Contest Irregularities: The Organizers are not responsible for printing or typographical errors in any Contest- related materials. The Organizers are not responsible for any lost, late, delayed, illegible, incomplete or misdirected entries. The organizer assumes no responsibility or liability for failure of the Internet or the Contest website during the contest period or for any other problem or technical malfunction in the operation of the Contest. If in the opinion of the Organizers, the administration or integrity of the Contest has been compromised the Organizers reserve the right to modify, suspend or cancel the Contest, including without limitation, terminating the Contest and awarding the prizes by random drawing from all non-suspect entries received as of the termination date. If the Contest is cancelled, modified, suspended or terminated notice will be posted on the Contest website located at www.paddleintheparkcontest.ca

Publicity: Except where prohibited by law or regulation, by submitting an entry and accepting a prize each winner grants the Organizers (and their nominees) a license to use the winner’s name, photograph, voice, likeness and the whole or any part of any statement or statements he/she has made or makes concerning the Contest or the Prize, in connection with any publicity, promotion or advertising of any nature, whether or not related to the prize or Contest, and each winner hereby consents to such use without further notice, consent, approval or compensation. Each winner agrees to make his/herself reasonably available for an opportunity to have photographs taken of him/her. The winners also agree that the Organizers may publish their name, city and province of residence as being a winner of the Contest.

Restrictions: The following are prohibited and will result in automatic disqualification from the Contest: (1) viewing or tampering with the Contest organizer’s systems, source code or data; (2) using any method that artificially increases odds of winning; (3) noncompliance with these Official Rules; or (4) any other act which the Organizers determines, at its sole discretion, would jeopardize the integrity of the Contest.

Photo Manipulation: Photos that are required to be altered to conform to Paddle Point tasks or for bonus points (e.g. adding the PITPC flag or text to a photo using photo editor software, for example Photoshop) will not be accepted.

Facebook and Twitter: While the Contest is advertised through Facebook and Twitter, the Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook nor Twitter. The information provided in an entry form is being provided to the Organizers and not to Facebook, nor Twitter. By participating in the Contest, each participant agrees to fully and completely release Facebook and Twitter of and from any and all liability whatsoever that may arise in any way in connection with the Contest.

Privacy: The personal information that you provide to the Organizers will be used for the purposes as set out herein and in administering the Contest. Changes to the Contest: The Organizers reserve the right to change the terms of this Contest, suspend or cancel it, at any time, for any reason, without liability on the part of the Organizers or Sponsors, and without prior notice.

Entries: All #PaddlePoints photos/entries and all supplied paddle finder/paddle winner photos and/or videos as supplied by the entrant, become the property of the Organizers and the receipt of any entry will not be acknowledged and no entry will be returned.

Governing Law: A prospective participant may not participate in the Contest where it is prohibited. The interpretation of these Official Rules and all matters relating to the rights and obligations as between any participant and the organisers in connection with the Contest shall be governed by, construed and interpreted in accordance with the laws of Ontario, without giving effect to any choice of law or conflict of laws rules or provisions. The Organizers and all participants hereby agree to attorn to the jurisdiction of the courts of Ontario, Canada, sitting in the City of Huntsville or the City of Hamilton (and all courts of appeal there from) as per the decision of the Organizers, in respect of the determination of any matter, issue or dispute arising in relation to these Official Rules, the Contest or the acceptance or use of the Prizes and agree that any such determination shall be sought solely and exclusively before such courts.

Discrepancy with Other Material: In the event there is a discrepancy or inconsistency between the terms and conditions of these Official Rules and any other material relating to the Contest, these Official Rules shall prevail, govern and control. In the case of a discrepancy or inconsistency between these Official Rules and the Waiver and Assumption of Risks both will apply separately.

Third Party Trademarks: The names of any individual, group, company, product or service mentioned herein or on other Contest material, and any corresponding likeness, logo or image thereof, have been used for identification purposes only and may be the copyrighted properties and trademark of their respective owners. The mention of any individual, group or sponsors, or the inclusion of a product or service as a Prize or on Contest material, does not imply any association with such individual, group or sponsor, the manufacturer or distributor of such product or service or the product or service itself and, except as otherwise indicated, no association is intended or should be inferred.

Decisions: The decisions of the Organizers are final and will be binding on all participants with respect to all aspects of this Contest, including but not limited to, eligibility of participants, compliance with these rules and the correctness of the answer to the skill testing question.

Entrants must own all rights to the photographs submitted. As such, entrants hold the Paddle In The Park Contest, Badger Paddles and Portageur.ca, and all contest Organizers, supporters and sponsors, harmless from any breach of copyright. Photographs that violate or infringe upon another person’s copyright are not eligible.

By uploading or submitting any photograph to the Paddle In The Park Contest website, the Contestant grants (or warrant that the owner of such materials expressly grants) Paddle In The Park Contest and the Organzers, a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose, including, but not limited to advertising and promotional materials, its website, exhibition, and commercial products, including but not limited to Paddle In The Park media and publications. The Organizers will not be required to pay any additional consideration or seek any additional approval in connection with such uses. Winners and/or some entrants may be required to sign a release containing the above conditions.

A note from the Organizers: It’s unfortunate that we have to use that kind of language to protect our fun little contest. While we will absolutely never sell any submitted photos, we would however like to display them on the Organizer’s website/social media accounts or use them for promotion of the contest, and for that we need to be legally clear. We understand that this language might make you uncomfortable, so we recommend that you do not share any photos that cannot be made public or any high resolution photos that you are planning to sell elsewhere, especially with exclusive rights.
